PRIVACY & DATA POLICY

Effective January 1st, 2018

 

FieldAlytics Solutions Canada Inc. recognizes that your Production Data may provide tremendous value to you. In fact, it’s the foundation of our business: to ensure you unlock the value of your own Production Data. We undertake to properly store, protect and care for your information as best we can. You generate and own your Production Data, and you always have the right to access and retrieve your Production Data as wish, and you may always erase your FieldAlytics Account at any time.

 

While we do not currently sell your information to third parties, elements of your Production Data  may become part of Aggregate Data within the FieldAlytics system, which drives better analytical tools for all users. This Privacy & Data Policy provides a detailed explanation of how we we will treat your data.

 

The following Privacy and Data Policy (“Policy”) discloses the Privacy and data use practices of FeildAlytics Solutions Canada Ltd. (“us,” “we,” or “our”) for all data or information we receive from you, either directly or through a third party, including, without limitation, in person or by phone or through websites, digital applications, equipment, sensory devices or the provision of services to you.  We created this Policy to communicate our privacy and data policies to each of our users (collectively a “Customer,” “you” or “your”).

 

1. CONFIDENTIAL INFORMATION

 

If you have a FieldAlytics Account, you will have provided Confidential Information to use the Licenced Services. FieldAlytics will keep confidential your Confidential Information, unless it must be shared with a third party for the provision of the Licenced Services, or if required by law, in which case FieldAlytics will take commercially reasonable steps to ensure the third party protects and keeps confidential its Customer’s Confidential Information.

 

“Confidential Information” means any non-public data, information and other materials regarding the identity or business of a Customer (and, if either party is bound to protect the confidentiality of any third party’s information, then of such third party) provided to one party by the other party, where such information is marked or otherwise communicated as being “proprietary” or “confidential” or the like, or where such information should, by its nature, reasonably be considered to be confidential and/or proprietary. Additionally, Confidential Information includes information relating to either party’s business plans, customers’ names or contact information, financial information, and the like, that is disclosed by one party to the other.

 

“Licenced Services” mean access to, and use of an internet-hosted and user-accessible database service called FieldAlytics that integrates the collection, compilation, analysis, reporting and manipulation of geospatial data respecting land, water and growing crops, enabling a producer, agrologist or trained technician to develop and deliver crop application, seeding and nutrient prescriptions for agricultural equipment, and to report comprehensively on the producer’s crop production business.

 

“FieldAlytics Account” is a single user-identified internet-hosted digital account with FieldAlytics, licenced through FieldAlytics, that provides a user access to the Licenced Services.


 

2. PRODUCTION DATA

 

FieldAlytics may retain all a copy of all Production Data received from its Customers and may use and report the data as Aggregate Data for: a) analytical purposes and aggregate reporting, to other FieldAlytics users or trusted third parties who provide services to FieldAlytics or FieldAlytics users, at FieldAlytics’ sole discretion; or b) for purposes that FieldAlytics deems will improve the profitability, efficiency and general state of agricultural production, or will lead to advances in scientific research.

 

Aggregate Data disclosed by FieldAltyics shall be free from any of its Customer’s Confidential Information, notwithstanding that all Production Data collected by FieldAlytics is related to geographic locations, respecting which, certain information, including, but not limited to, ownership or lease of the land from which the data was drawn, may be determinable by any person through the use of publicly accessible property registries and listings, which shall not constitute a breach of FieldAlytics’ obligation to its Customers.

 

“Production Data” means all information submitted to FieldAlytics through use of the Licenced Services that may or may not be Machine Data, respecting a Customer's soil characteristics, crop inputs, crop yields, climate data and geographic information.

 

“Machine Data” means a digital recording of applications, sensory readings or work that an agricultural implement or agricultural sensor has performed or collected on land, and the relevant metadata respecting that work, including but not limited to: rates of application, equipment speed, course of travel, product names, date of operation, as recorded, reported and stored or transmitted by the implement or sensor.

 

3. UPDATES & CHANGES TO POLICY

 

We reserve the right, at any time and without notice, to add to, change, update, or modify this Policy by posting such addition, change, update, or modification on our website.  Any such addition, change, update, or modification will be effective immediately upon posting on our website.
